Agriculture accounts for a significant portion of the U.S. economy and land area, and is subject to a growing list of environmental regulations including the Clean Water Act; Clean Air Act; Comprehensive Environmental Response, Compensation and Liability Act; Resource Conservation and Recovery Act; Toxic Substances Control Act; Emergency Planning and Community Right-to-Know Act; Endangered Species Act; and Federal Insecticide, Fungicide and Rodenticide Act. While historically agriculture has benefited from exemptions from some of these regulations, frequent legal challenges and regulatory responses to court decisions are eroding some of the exemptions and raise significant potential legal liabilities.
