Federal Compensatory Mitigation Regulations for Development Impacts to Wetlands and Waters

In this quick preview, we will discuss the wetland mitigation requirements that need to be addressed should your development project impact wetlands and/or open water resources. The listener will gain an understanding of the important aspects of the rule on Compensatory Mitigation for Losses of Aquatic Resources, which was adopted by the U.S. Army Corps of Engineers (USACE) and U.S. Environmental Protection Agency (USEPA) in 2008. Topics to be presented include wetland mitigation banking, in-lieu fee programs and permittee-responsible mitigation. During the course we will review these Federal mitigation regulations and discuss the planning and permitting process applicants will encounter in order to successfully address wetland mitigation as part of the overall permitting process for development projects.

Mitigating the Environmental Impacts of Hydraulic Fracturing

In this 10-minute preview, we will focus on state and federal agencies as well as ordinary citizens that have expressed concern about the volumes of water and unidentified chemicals used during the hydraulic fracturing process, the “flowback” fluids that remain after the process is completed, surface water contamination, pollution of the land, air quality, and earthquakes. These impacts can be minimized with the disclosure of fracturing fluids, baseline water testing, use of “green” products, fluid management and minimization, air emission reduction, well integrity testing, and contractor management. This preview will provide information on the results of research and studies concerning water, land, and air contamination and earthquakes and discuss state and federal regulations concerning fracturing fluid disclosures, air emissions, and well integrity issues.
